These Terms of Service ("Terms") are a legally binding agreement between you ("User," "you") and gethigherincome.com, together with its parents, affiliates, successors, and assigns (collectively, the "Company," "we," "our," or "us").
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

- Eligibility or opportunity assessment tools
- Data analysis and predictive systems
- Programmatic digital interactions conducted on your behalf
The Services may be modified, expanded, or discontinued at any time.
3. Assumption of Risk for Automation and AI
You understand and agree that:
- AI systems generate probabilistic outputs and may be incorrect.
- Automated interactions may not function as intended.
- Third-party systems may block, reject, or restrict automated submissions.
- Use of automation tools may violate third-party terms of service.
- You assume all risks arising from automated or AI-assisted use of the Services.
The Company disclaims liability for:
- Rejected submissions
- Platform account suspensions
- Employment disputes
- Alleged misrepresentations
- Missed communications
- Opportunity loss
4. No Guarantee of Outcomes
The Company does not guarantee:
- Interviews
- Employment offers
- Compensation increases
- Loan approvals
- Credit decisions
- Financial outcomes
- Platform acceptance of submissions
All decisions are made independently by third parties.
Nothing in these Terms constitutes an admission that the Company is a consumer reporting agency under the Fair Credit Reporting Act.
5. Third-Party Platforms and Services
The Services may integrate with or interact with third-party websites, systems, or platforms.
The Company does not control and is not responsible for:
- Third-party terms
- Third-party decisions
- Platform restrictions
- Data handling by third parties
Your interactions with third parties are solely between you and those parties.
6. Intellectual Property
All software, algorithms, artificial intelligence models, analytical frameworks, scoring methodologies, databases, and related technologies are owned exclusively by the Company or its licensors.
You grant the Company a perpetual, worldwide, royalty-free license to use information you provide for purposes of:
- Operating the Services
- Improving models and systems
- Analytics and research
- Commercial development
Aggregated, de-identified, anonymized, and derived data constitute Company intellectual property to the fullest extent permitted by law.
No ownership rights are transferred to you.
7. Disclaimer of Warranties
The Services are provided "as is" and "as available."
To the maximum extent permitted by law, the Company disclaims all warranties, express or implied, including:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY
- RELIABILITY
- UNINTERRUPTED AVAILABILITY
You agree that you have not relied on any statement or representation not expressly set forth in these Terms.
8. Limitation of Liability
To the maximum extent permitted by law:
The Company shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of opportunity, loss of data, or reputational harm.
The Company's total aggregate liability shall not exceed the greater of:
- One Hundred U.S. Dollars ($100), or
- The amount you paid to the Company in the prior twelve (12) months.
If you paid nothing for the Services, liability is capped at $100.
9. Indemnification
You agree to indemnify, defend, and hold harmless the Company from and against any claims, liabilities, damages, losses, and expenses arising out of:
- Information you provide
- Content transmitted pursuant to your authorization
- Your violation of third-party terms
- Your misuse of the Services
- Your breach of these Terms
10. Arbitration Agreement
You and the Company agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved exclusively through final and binding arbitration on an individual basis.
Arbitration shall be administered by the American Arbitration Association under its Consumer Arbitration Rules.
You waive the right to a jury trial.
11. Class Action Waiver
You agree that disputes will be resolved only on an individual basis.
You waive any right to bring or participate in a class action, collective action, or representative proceeding.
If this waiver is deemed unenforceable, the arbitration provision shall be void.
12. Governing Law and Venue
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
If arbitration is found unenforceable, exclusive jurisdiction shall lie in the state or federal courts located in Delaware.
13. Assignment
The Company may assign or transfer these Terms without restriction, including in connection with:
- Merger
- Acquisition
- Asset sale
- Financing
- Corporate restructuring
You may not assign these Terms without written consent.
14. Severability and Survival
If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
